We want you to be able to fully engage, focus on learning, and interact with peers at Classy’s 2022 Collaborative (the “Collaborative”) with ease. With this in mind, Classy, Inc. (“Classy”, “we” or “us”) is working to ensure you are connecting in the safest environment possible. These Classy Event COVID Protocols (“Protocols”) are part of the Classy Events Terms and Conditions (the “Agreement”) and are incorporated by reference into that Agreement. By clicking “Submit” on the registration page, checking the box regarding acceptance of the Protocols, or by attending or participating in the Collaborative, you confirm that (1) you have read, understand and agree to the Protocols and the Agreement, and (2) you are at least 18 years of age, or if registering on behalf of a minor, you are authorized to agree to the Protocols and the Agreement on behalf of said minor. Classy reserves the right to modify, adjust or update the Protocols at any time and without notice in its discretion to ensure the safety of Collaborative attendees. You agree to check the Protocols regularly for any modifications or updates.

Out of respect for all attendees, Classy is implementing safety measurements that comply with best practices and recommendations of healthcare providers. Classy requires all attendees to follow such safety measures, including, but not limited to, those set forth below. To meet these standards, attendees must adhere to the following guidelines. Attendees not in adherence with these Protocols will be refused entry to the Collaborative or expelled from the Collaborative, at Classy’s discretion, and such attendees will not receive a refund. 

Proof of Vaccination or Negative COVID-19 Test Result

All Collaborative attendees will be required to provide proof of “full vaccination” (as defined in the following paragraph) against COVID-19 or, if an attendee is not fully vaccinated, such attendee must provide proof of a negative COVID-19 test result (at-home test, rapid test, or PCR test) taken within 48 hours of the first event they are attending in order to collect their Collaborative registration credentials. When you arrive at onsite registration, you will be prompted to provide satisfactory proof of vaccination or satisfactory proof of a negative COVID-19 test result taken within 48 hours of the first event you are attending. Proof of “full vaccination” may be provided by showing your vaccination card or a photo of your vaccination card and corresponding identification. Proof of a negative COVID-19 test may be provided in the form of a document displaying negative test results or a photo of an at-home or rapid test showing a negative result.

An individual is considered “fully vaccinated” if it has been at least 14 days since the person received the last dose, as recommended by the manufacturer, of a vaccine that has been authorized by the FDA for use in the United States, including vaccinations that have been approved pursuant to an Emergency Use Authorization. For persons fully vaccinated outside of the United States, the vaccination must be listed for emergency use by the World Health Organization (WHO).

For attendees who are not “fully vaccinated” and need to provide proof of a negative COVID-19 test result within 48 hours of the first event, you may use at-home tests, rapid tests, or PCR tests (the latter only if results will be available in time). If you arrive without proof of vaccination or proof of a negative COVID test, Classy will endeavor to provide you with a self-administered rapid test to perform on site prior to entry while such supplies last. 

This Protocol will cover attendees at the Collaborative entering any event venues. All Classy-event attendees must abide by all other regulations and venue policies as provided by any such venue. 

In addition, if you have tested positive for COVID-19 in the last 14 days, been exposed to someone that has or might have COVID-19, are feverish or experiencing cold or other COVID-19 symptoms, or you suspect you may be ill, we kindly request that you do not attend the Collaborative. If this is the case, please reach out to our staff at [email protected] to reschedule your participation in virtual Collaborative. At Classy’s discretion, you may be allowed to transfer your Collaborative ticket to another member of your organization. 

Mask Policy

The mask policy, outlining when and where masks will be required, will be updated as the Collaborative approaches. As we closely monitor variants and evolving safety standards, we will continue to adjust our policy to ensure attendees can network and engage in the safest environment for everyone. As of May  2022, attendees are advised but not required to wear masks indoors. Classy strongly encourages attendees to wear N95 or KN95 masks and Classy will provide such masks for any attendees that would like to wear one. This requirement remains subject to applicable laws and public health guidance. Classy will continue to monitor travel and safety regulations and will update attendees accordingly if these Protocols change. 

Limitation of Liability

Notwithstanding implementation of these Protocols and best practices, you specifically acknowledge that an inherent risk of exposure to COVID-19 and other communicable diseases exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. According to the Centers for Disease Control and Prevention, senior citizens and those with underlying medical conditions are especially vulnerable. 

BY ATTENDING THE COLLABORATIVE IN PERSON, YOU VOLUNTARILY ASSUME ANY AND ALL RISKS RELATED TO EXPOSURE TO COVID-19 AS WELL AS ANY OTHER COMMUNICABLE DISEASE FROM THE COLLABORATIVE AND THE VENUES, HOTELS, AND OTHER FORUMS HOSTING THE COLLABORATIVE. YOU HEREBY RELEASE CLASSY AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, AGENTS, SUCCESSORS AND ASSIGNS (COLLECTIVELY, THE “CLASSY PARTIES”) FROM ANY AND ALL LIABILITY IN CONNECTION THEREWITH EXCEPT WHERE IT WOULD BE UNLAWFUL TO DO SO.

WITHOUT LIMITING THE FOREGOING, IN NO EVENT WILL (a) THE CLASSY PARTIES BE LIABLE FOR ANY LOSS OF BUSINESS, BUSINESS INTERRUPTION, LOSS OF BUSINESS OPPORTUNITY, LOSS OF DATA, LOSS OF PROFITS, COST OF COVER OR OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL, INDIRECT, PUNITIVE, EXEMPLARY, OR RELIANCE DAMAGES, AND (b) THE LIABILITY OF THE CLASSY PARTIES FOR DIRECT DAMAGES UNDER THESE TERMS EXCEED $100. Classy does not exclude or limit our liability where it would be unlawful to do so.

In addition, you hereby irrevocably waive and relinquish any and all rights which you may have under the provisions of Section 1542 of the Civil Code of the State of California, which Section reads as follows:

A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, AND THAT IF KNOWN BY HIM OR HER WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.

Force Majeure  

Classy and the Classy Parties will not incur any liability to you on account of any loss, claim, damage, or liability to the extent resulting from any delay or failure to perform all or any part of the Agreement, if and to the extent such delay or failure is caused, in whole or in part, by events, occurrences, or causes beyond the reasonable control and without any negligence on the part of the party seeking protection under this Section, including delays or failures, acts of God, strikes, pandemics, lockouts, riots, acts of war, terrorism, earthquake, fire, or explosions, or resulting, directly or indirectly, from COVID-19 or any variants thereof, including but not limited to shutdowns, “Shelter-in-Place,” curfews, or any other quarantine order imposed at a city, county, state or Federal level.  However, if Classy cancels the Collaborative as a result of a Force Majeure event, Classy will endeavor to provide a full refund of paid registration fees as soon as practicable following notice of such cancellation. Classy will not be liable for a refund or reimbursement of any other fees or expenses incurred directly or indirectly with the Collaborative.
